These Terms govern your access and use of our services, deliverables, and website. By engaging with Exclusivepickhub you agree to be bound by these Terms and any written engagement letter or statement of work.

Key points

  • Deliverables are defined in a statement of work (SOW). Timeframes are estimates unless fixed in writing.
  • Any changes to scope will be quoted and agreed in writing.
  • Payment terms: invoices payable within the agreed days in the SOW. Late payments may accrue interest.

Liability, warranties and consumer law

To the extent permitted by law, Exclusivepickhub limits its liability and provides services on an 'as is' basis. Nothing in these terms seeks to exclude rights that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986 where they apply.

Where applicable, our liability for direct loss is limited to the fees paid for the relevant services in the preceding 12 months; we are not liable for indirect or consequential loss except where required by law.

Intellectual property

Unless otherwise agreed in writing, Exclusivepickhub retains ownership of pre-existing IP. On full payment for commissioned works, we grant the client a licence to use deliverables as specified in the SOW. We do not assign third-party or open-source components beyond the applicable licence terms.

Clients must not remove or tamper with notices, attributions or licence files included with deliverables.
